1. Definitions

‘You’ and ‘Your’ mean the person who is registering for the email and/or SMS Service.
‘We’, ‘Us’ and ‘Our’ mean Huntingdonshire District Council.
‘Service’ means the Huntingdonshire Emergency Warning System (HEWS) scheme offered by Huntingdonshire District Council.  Under this scheme eligible individuals can opt to receive a Message warning of an Emergency within the district of Huntingdonshire.
‘Emergency’ means an emergency as defined under the Civil Contingencies Act 2004.  This is an event or situation which threatens serious damage to human welfare in a place in the UK, the environment of a place in the UK, or war or terrorism which threatens serious damage to the security of the UK.  Emergencies reported as part of HEWS are those which occur within the district of Huntingdonshire.
‘Message’ means information sent to You by either SMS text or email.

2. Eligibility and subscription to the service

  1. To be eligible for the Service You must be resident within, or work within, the geographical area managed by Huntingdonshire District Council.

  2. If You are under 16, You must get permission from Your parent or guardian before You subscribe to the Service.

  3. You can opt to receive SMS text alerts and / or email alerts.  Messages sent by Us to You are free of charge.

  4. You can join the scheme by using the subscription form provided on Our website.  If You do not have access to the internet or an email address You can subscribe by contacting Our Customer Service Centre or by calling into Our Customer Service office.

  5. You must provide Your home address if You are a resident within Huntingdonshire (regardless of where You work) or Your work address if You work, but do not live, within Huntingdonshire.

  6. You can register one email address and / or one mobile phone number registered on a UK network.

  7. We can not provide the Service to any fixed line telephone, a computer capable of receiving text messages or a virtual mobile phone number (those that start ‘070’).

  8. Subscription to the email only service, or email and text service, is by positive opt-in.  Once You have completed the subscription form on Our website an email will be generated to the address provided by You, to confirm the address is correct and You wish to subscribe to the Service.  Registration for the Service will not be completed until You have responded to this email as instructed.

  9. The text only service is not currently covered by positive opt-in.

  10. We will audit the data supplied to Us from time to time.  If We believe from the information You have supplied that You do not meet the eligibility criteria We will remove You from the Service without notice.  We may also contact You to check that the details We hold for You are correct.

  11. Once You have subscribed to the Service You will be deemed to have accepted the Terms and Conditions as set out in this document.

3. Email service

  1. You must be the owner, or an authorised user, of the email address you register under.

  2. You must tell Us if You change Your email address so that We can ensure Our records are up to date.  If You do not tell us of changes We will continue to send messages to the email address you provided.

  3. You will be provided with a user name and password to log into the email subscription service.  You will keep these details private and ensure their security.  We will not be liable for any loss any loss, damage or expenses arising out of, or in connection with, access to Your account by an unauthorised person.

  4. If We receive two undeliverable messages to Your email address in a row We will remove You from the Service without notification.

4. SMS service

  1. You must be the owner, or an authorised user, of the mobile phone You are using for the SMS Service.

  2. You must tell us immediately if Your phone is lost or stolen, or if You change the mobile number You gave Us.  If You do not tell Us, We will continue to send messages to the mobile number You supplied.

  3. You understand that if Your phone is switched off or out of coverage for a period of 7 days or more Your network provider may delete any SMS messages received by You.

  4. You understand that the SMS Service may, at any time, be adversely affected by problems with Your mobile phone network, including, without limitation, network coverage.  We are not responsible or liable to You for any loss, damage, direct or indirect expenses incurred by You as a result of any difficulties experienced with Your mobile phone service provider.

  5. You are responsible for paying charges on any text messages You send to Us.  You will be charged by Your mobile phone service provider according to the tariff You have with Your provider.

  6. Our Offices are at Pathfinder House, St Mary’s Street, Huntingdon, Cambridgeshire, PE29 3TN.  The text messages will be sent to you without the details of our offices.

5. Message content

  1. The content of any Message sent from Us is for general information purposes only.  Any reliance on this information is at Your own risk.

  2. Although We will take reasonable steps to ensure that the information contained within the Message is correct, You should be aware that the information may be incomplete, inaccurate or out of date.  No liability can be accepted for any inaccuracies or errors.

  3. Messages will contain only basic information relating to the Emergency.  Further information will be available on Our website, www.huntingdonshire.gov.uk.  While We will take reasonable steps to ensure the information on Our website is correct, You should be aware that the information may be incomplete, inaccurate or out of date.  No liability can be accepted for any inaccuracies or errors.  Any reliance on information posted on Our website is at Your own risk.  Use of the website is subject to our website usage policy.

  4. Messages may be sent at any time during a 24 hour period, depending on the time the Emergency occurs.  The decision whether, and at what time, to send messages is at Our discretion, and is assessed on a case-by-case basis by Our Emergency Planning Team.

  5. For Emergencies occurring after 11pm and before 6am a timed delay may be placed on SMS text messages, so that it is sent after 6am.

  6. We may have to interrupt the Service to carry out maintenance, or for reasons beyond our control.  We will try and keep such interruptions to a minimum but cannot guarantee that the Service will be available during an Emergency.

  7. We may occasionally send out test Messages as part of our Emergency Planning Test process.  Any test messages will be clearly identified. 

    We are unable to reply or action any messages sent from You that are not related to confirming subscription or a request to unsubscribe.  If You wish to contact Us about anything else, You should contact our Customer Service department (email mail@huntingdonshire.gov.uk or telephone 01480 388388).  Full details on other ways to contact Us are available from Our website.

6. Unsubscribing

We will respect Your right to unsubscribe and We will remove You from the Service as soon as is reasonably practical, once We have received notification from You. 

  1. To unsubscribe from the SMS Text service, text ‘Stop’ to +44 (0)7797 805377.

  2. To unsubscribe from the email service go to the website and edit Your details from the email subscription form.  Emails sent by Us in connection with the Service will also contain an "unsubscribe" link, to easily allow You to unsubscribe.

  3. You can also unsubscribe to either or both of the Services by contacting our Customer Service department (email mail@huntingdonshire.gov.uk or telephone 01480 388388). 

7. Feedback

Should You wish to give Us feedback about the service You can do so by using the Feedback Form available on Our website.

8. Data protection and privacy

  1. The information collected by Us is used to fulfil Your request to join the Service.  Any information You supply to Us will be processed in compliance with the principles set out in the Data Protection Act 1998.  We have a duty to protect the public funds We hold and so any information provided by You may be used to prevent and detect fraud.  The information may be shared, for the same purpose, with other organisations which handle public funds.

  2. We reserve the right to contact You from time to time via email, text or post for the purposes of research / review of the Service or to tell You about other Services provided by Us that may be of interest to You.

9. General

  1. This Service is not designed to replace any other existing warning systems, such as the Environment Agency’s Floodline.  It is designed to enhance the level of information being given to the local communities.

  2. We reserve the right to stop the Service at any time by giving You 28 calendar days notice, or immediately if required to do so by law.

  3. To the extent permitted by law, We disclaim all warranties of any kind, whether express or implied and neither We, or any of Our information suppliers, offices, employees or agents shall be liable for any loss, damage or expenses arising out of, or in connection with, the use of the information distributed by the Service.

  4. Terms and Conditions may change from time to time.  We will inform you of any change and ensure that the Terms and Conditions are published on Our website.

  5. These Terms and Conditions are governed by English Law and any disputes will be settled by English Courts.

10. Non-acceptance of these terms and conditions

If You do not agree to these Terms and Conditions We are unable to offer You the Service.  You should not register Your details with Us for the purposes of registering for this Service.
