Air Pollution


Local Authority - Pollution Prevention and Control (LA-PPC)


Regulations made under the Pollution Prevention and Control Act 1999, amended by the Environmental Permitting Regulations 2007, require a range of industrial processes with the potential to cause pollution, to obtain a permit before operating.


These industrial processes are split into three designations: Part A(1), Part A(2) and Part B.  Permits covering Part A(1) and Part A(2) sites will consider issues such as: emissions to air, land, water and energy and water usage.  A Part B permit only considers emissions to air.  The Environment Agency regulates Part A(1) sites and the Council regulates Part A(2) and Part B sites.


The Council’s Environmental Protection Team control approximately 70 processes, which include industries such as:
• bulk cement production
• rubber processing
• timber processing
• timber coating
• vehicle respraying
• galvanising
• printing works
• printing ink production
• roadstone coating
• animal feed production
• metal decontamination
• mobile crushing
• waste oil burners

Defra has produced a series of process and sector guidance notes that explain all the potential releases and Best Available Techniques and suggests conditions to be included within the permit.  These guidance notes can be found by using the ‘defra Guidance Note’ link to the right of this text.


Routine compliance inspections are undertaken to ensure these processes comply with conditions set in order to minimise the release of pollutants to the environment.  Permits also ensure that the legislative requirements of, for example the Clean Air Act, or nuisance legislation are met as once a permit has been granted action cannot be taken under these laws.


To apply for a permit you will need to complete the relevant application form and submit it to the Environmental Protection Team along with any additional information and correct application fee.  The fees are set by defra and can be found on their web page.  It is advisable to contact the Environment Protection Team before submitting the application to discuss the application and requirements.


New applications are consulted with any relevant bodies, although anyone can submit representations during the consultation period which will be considered when drafting the permit conditions.  Lists of new applications and their representation dates can be viewed in ‘Air Pollutions - New Applications’ in the linked documents to the right of this text.  Any comments should be made to:
